This paper analyzes some philosophical problems examined by Kant regarding time in the formation and execution of contracts. It is argued that these difficulties arise, first, from the incorporation of the promise as a constitutive act of the contract and, second, from the adoption of the Roman legal distinction between real rights and personal rights. Finally, an interpretation of Hegel’s theses on the contract is proposed, which allows for resolving these temporal difficulties.
